Legally Insane – Can Trump Hide His Tax Returns – Episode 98

In this episode Matt and Tony get into the latest Trump legal fiasco. An NY Judge ruled that he cannot use the DOJ guideline to hide his tax returns. In a quite blistering ruling, the Judge basically called it an outrage to justice. It will be in front of the 2nd circuit soon. It made the guys decide to a deep dive into the IRS website to find out what other frivolous arguments people are using to get out of paying their taxes. Nobody did it better than the legendary Wesley Snipes, well except for the fact that he got 3 years. They also award the Legally-In-Shame of the week to Dominos Pizza who denied a blind man access to their website. The Supreme court ruled they had to make it ADA compliant so he too could get wasted and share in the grossness.

Employer Liability- French Man’s Affair Considered Within The Scope of Employment – Ep 96

When is an employer held liable for an employee’s actions? It depends on the scope of work, or employment. The legal scope of employment is the range of activities that an employee is reasonably expected to do as part of his or her job. Within this range of activities, the employer may be held liable for the employee’s actions when a third party is injured by the employee’s conduct. Today Matt and Tony examine a recent French case involving scope of employment as well as several other funny US cases.

  • The US Scope Of employment
  • Helicopter crashed cause by clipboard
  • The Country Club testicle
  • A tub of tampons

School Busing – What The Heck Were Kamala and Biden Talking About – Ep 88

The 2020 Democratic debate has come and gone, but the interaction between Kamala Harris and Joe Biden is still in the news. Kamala Harris accused Joe Biden of supporting segregationist senators and opposing bussing. Desegregation Bussing is the practice of transporting students to schools in different neighborhoods in an effort to address racial segregation. Biden has since denied opposing bussing overall. Today, Matt and Tony dissect the uproar between Joe and Kamala and discuss the history of Bussing.

Highlights:

  • Brown vs. Board of Education
  • Swann v. Charlotte-Mecklenburg, ruled the courts can use bussing as a desegregation tool.
  • The White Flight
  • The Second Great Migration
  • Southern Manifesto
  • A 1999 poll showed 82% agreed that letting students go to their neighborhood school would be better than achieving racial balance through bussing
  • In The Roberts Court, the Supreme Court struck down a lot of race based integration plans

The Takeaway – For better or worse the majority of the American public is against bussing.

It’s Not a Concentration Camp, but It’s Still Hellish. The Border Crisis and The Flores Lawsuit that Stopped Child Strip Searches – Ep 87

In today’s episode Matt and Tony are going to be discussing the recent situation with immigrants being detained at the boarder. Children are being separated from their families and are being kept without things like toothpaste, soap and blankets to sleep with. There’s currently an estimated 52,000 people being detained at the boarder and there’s really no clear-cut solution on what to do with these people and how to provide with them adequate human necessities and living conditions.

Highlights:

  • Determining the detainee’s needs
  • Strip searching immigrant teens and children in the 1980’s, at the US boarder
  • The Flores Settlement Agreement
  • Immigrants claiming asylum get priority at the boarder
  • The definition of asylum is loosening
  • As of May 20th, 2019 more than 52,000 people are being detained by ICE
  • Trump claims 90% of the immigrants at the boarder don’t attend their hearings. The Left claims its closer to 20%

The Takeaway – We need to stop looking at people like they’re objects. We need to humanize the situation and figure out how to properly care for, treat and process these immigrants. There’s not easy solution, but this is a bi-partisan humanitarian crisis.

What to do About Morals Clauses in the Age of Cancel Culture – Ep 86

Cancel culture upon us, it seems that every time an actor, or high profile person makes a mistake, the public wants to end their career. That’s why today were touching on Morals Clauses. Morals Clauses are provisions within the instruments of a contract, which curtail certain behavior of individuals. I.e. if a Nike sponsored athlete screws up, Nike has to right to revoke their sponsorship or payments to that person. Today you’ll learn why high profile people might start pushing back on these clauses.

Highlights:

  • Universal Studios wrote the first known morals clause, for actors
  • Babe Ruth’s indulgences
  • In the 19040’s and 50’s morals clauses found their way into politics
  • The Hollywood 10
  • Loews v. Cole
  • Dimitri Marick’s coke problem
  • Nike Kept Kobe, Tiger Woods and Ben Roethlisberger’s contracts
  • Reverse Moral’s Clauses
  • Enron Stadium – Houston Astro’s debacle

The Takeaway – Celebrities and Athletes need to think long and hard whether they need to push back on morals clauses, so their contract doesn’t get voided by some mistake they made in their past, that society digs up on them.

The Central Park Five – Was Trump The Cause of Their Jailing – Ep 85

The Central Park jogger case was a criminal case based on the assault and rape of Trisha Meili, a white woman who was jogging in the park the night of April 19th, 1989. Four African American teenagers and one Hispanic teenager that were in the park that night were accused of the crime. The prosecution based their case on the alleged coerced testimony of the teenage boys. The 5 boys were convicted and received sentences ranging from 5-15 years. During the trial Donald Trump wrote and article calling for the death penalty, for criminals who commit these types of crimes. Today Matt and Tony are going to be breaking down the case and analyzing Trump’s influence on the effect of the outcome of the case.

Red Flag Laws – Maybe We Can Do Something About Gun Violence – Ep 84

Today the guys are re-touching on Gun Control. While it might not seem like anything is being done to protect people from irresponsible gun users, there have actually been several policies put in place in the last couple years, by State Governments. The main talking point for today is “Red Flag Laws”, which are gun violence prevention laws that permit police or family members to petition a state court to order a temporary removal of a fire arm from a person who may present a danger to themselves or others.

Highlights:

  • Red Flag Laws
  • The problem is gun rhymes with fun
  • One averted suicide for every 10-11 gun removals/seizures
  • 85% of registered voters supported Red Flag Laws
  • NRA ghost writing articles opposing gun control laws
  • 2nd amendment sanctuary cities
  • Australia gun buy back/ban

The Takeaway – It may not seem like things are happening on the gun control front, but they are. It’s a slow moving process with many passionate opinions on all sides of the argument

Is Bill De Blasio Pulling a Prank? – Examining 2020 Contender – Pretenders – Ep 82

Today’s discussion is all about Bill De Blasio. Bill is current mayor of NYC and has announced his 2020 Presidential bid. De Blasio has always had the reputation of being a little bit of a simpleton. He’s done a lot of questionable things and had a lot of questionable ideas as mayor of New York. Matt and Tony are going to dig into his past on today’s episode and discuss some of his mostly worst moments as mayor, while touching on a few of the good things he’s campaigned for.

Highlights:

  • In a poll, only 5% of New Yorkers favored De Blasio for President in 2020
  • The infamous Cuban honeymoon
  • Accidentally killing the groundhog on groundhog day
  • Fork and knifing pizza
  • Free preschool for the kids of NYC residents
  • Bedtime Bill
  • Championing a $15 minimum wage
  • Loving the Boston Red Sox

The Takeaway – Though not the worst candidate, it’s unlikely that De Blasio will win the democratic bid.

The World’s Oldest Profession – Should Prostitution Be Legal? – Ep 81

Prostitution, the oldest profession in the world is the topic of today’s show. Matt and Tony are going to be discussing it’s origins, the laws surrounding it both past and present, it’s financial impact, the health and safety of prostitutes and some hilarious other tidbits that most people probably don’t know, about turning tricks.

Highlights:

  • The ancient Greeks and Romans mandated that prostitutes wear specific clothing and pay large taxes
  • Incels
  • In old France, prostitution profits were shared with French Universities
  • In NYC in the early 1900’s there were 200 active brothels and 75% of the cities male population had Venereal Disease
  • The origins of the terms “Hooker” and “Red Light District”
  • Comstock Law and The May Act
  • 10 of 17 counties in Nevada have legal prostitution
  • John’s School
  • Paying for sex is a 16 billion dollar industry

The Takeaway – Most prostitution laws were put into effect because of the huge amount of STD’s that were being transmitted; it wasn’t necessarily based on the moral implications of paying for sex.

Episode 80 – Facebook Trying to Avoid Liability – Are they Publisher or a Platform Under the Law

Episode 80 – Facebook Trying to Skirt the Law Again – Are they a Platform or Publisher.

Tony and Matt are back from touring and coming in hot. This week they explore whether Facebook, twitter and the various other social media juggernauts are controlling our flow of information without taking any responsibility or liability for it. We go all the way back to the beginning of the internet and discuss the old Prodigy case, remember them. The courts agreed that even though they were a platform they could take down obscene content to protect from the late 90s rash of pedofiles sneaking into chat rooms! Congress passed Section 230 of the Communications Decency act to allow for this type of oversight but it seems Zuckerberg, Dorsey and co. have decided to overreach and ban anyone who disagrees with them. For once Tony and Matt find themselves in agreement with Donnie Jr. and co who feel that Facebook is trying to have it both ways. If you’re a platform, you generally must remain content neutral. If you’re a publisher, you can take ownership over who gets to speak on your site, but you open yourself up to all kinds of liability that Congress shielded platforms from. Facebook is trying to have it both ways but it seems like the public and Congress is fed up. We’re eager to see how this plays out in the courts and in the legislature.

Jussie Smollett Walks – Proving Celebrities are Above the Law– Ep 76

Jussie Smollett recently had the 16 felony counts filed against him dropped. He walks with a $10,000 fine and some community service hours. None of this will appear on Smollett’s record. There’s mixed signals from Americans, some in support of Jussie, some outraged at the slap on the wrist he got. The verdict is controversial to say the least and you shouldn’t be surprised if Jussie Smollett stays under scrutiny for a while. In this episode, Matt and Tony discuss the verdict and how fishy it seems. There’s likely some collusion going on between Chicago government officials.

Highlights:

  • Pencil Neck Schiff
  • Smollett Walks Free
  • Obama aid collusion
  • Celebrity Privilege
  • Societal impact of falsifying hate crimes
  • Trump threatening Civil Suit

The Takeaway – Celebrities typically get away with crimes.

Calexit – Ep 68

Today’s episode is about the Calexit movement. Calexit is the term used to describe breaking California up into different sections based on geography. While not a new movement, the idea of isolation has gotten stronger because of Trumps presidency. Some people supporting the movement want California to become it’s own country, while others want to split it in half or even thirds. While CA does have the 5th largest economy in the world and a liberal free spirited attitude, splitting off from the US or getting chopped up into different states is not that simple. In this episode Matt and Tony discuss the movement, it’s possibly outcomes and the legalities behind splitting up The Golden State.

Highlights:

  • [02:58] – Brexit but for California
  • [04:44] – 220 official proposals to divide CA
  • [07:23] – The compromise of 1850
  • [08:20] – Shasta, not the soda
  • [08:45] – Pushing out Al Franken
  • [10:30] – A three way split proposal in 1992
  • [14:45] – The worlds largest economies
  • [15:10] – Cascadia
  • [17:05] – Would have to amend the constitution

The Takeaway – Although it’s possible to break up CA, it’s unlikely and would take major adjustments to the constitution.
